TruMedia Networks, Inc.  (“TruMedia”) is committed to respecting the privacy of your personal information in accordance with all applicable laws.  This Privacy Policy describes what information we collect related to your use our websites controlled by TruMedia, when and to whom it may be disclosed, and the choices we offer you to manage the information we collect.  TruMedia is the data controller of the personal information we collect from you.

A.    What information do we collect and how do we collect it?

1.     Information you provide to TruMedia.

TruMedia, or our service providers acting on our behalf, collect personal information you choose to provide so that you may use or access the TruMedia software or services and to help ensure that the software and services function properly. When you create an account and become a registered user of the TruMedia software or services, the personal information we collect may include, but is not limited to:

·       Email address;

·       Password;

·       Street address;

·       Telephone number(s);

·       Payment data;

·       IP addresses;

·       Location data;

·       Device data;

·       Usage data; and

·       Information about your interests and preferences.

2.     Technical Information. 

When you use the TruMedia software or services, TruMedia, or our service providers acting on our behalf, use cookies and similar technologies to collect a variety of information related to your browsing actions and how you engage with the TruMedia websites.  Cookies are text files with small pieces of data — like a username and password — that are stored within a web browser that the website can retrieve at a later time.  For example, TruMedia collects the IP address of the computer or device used to access the TruMedia website, your general location such as the region, city or zip code from which you are accessing the software or services, information about your operating system or device type, your website preferences, the date and duration of a website visit, or to keep you signed in. We use such technical information for internal purposes such as to enhance the functionality of our websites or improve user experience.  We may associate your technical information with your personal information, in which case we will treat such associated information as personal information.

In some instances, you may be able to set your browser not to accept cookies. However, some of our website features may not function as a result. 

3.     Device ID. 

When you use the TruMedia software or services, we or our service provider acting on our behalf may collect your unique Device ID. We may use such information for legitimate business interests for internal purposes and to provide you a better user experience. In some cases we may associate Device ID with your personal information, in which case we will treat such associated information as personal information.

4.     Information from third parties.

If you are an athlete who performs (or performed) in athletic events, including, without limitation, athletic tournaments, events, practices, exhibitions, games, meets or matches, we may receive information and other data about you from third parties related to you, for example, your name, height, weight, and metrics or statistics related to your on-field performance, some of which may be considered personal information under applicable law.  We accept such data on the basis that the third party data providers are legally permitted to disclose your personal information to us for use in connection with the TruMedia software and services. 

5.     Legal Basis or Legitimate Interest.

In cases you have purchased TruMedia software or services, the processing of your personal information will be necessary to perform a legal agreement by and between you and TruMedia.  In other cases, the processing will be necessary for our legitimate interests outlined above, except where such interests are overridden by your interests or fundamental rights and freedoms which require protection of personal data.

B.     How will we use or share your information?

Your information will not be sold, exchanged, transferred, or given to any other company outside of TruMedia, or our service providers acting on our behalf, for any reason whatsoever, without your consent, other than for the expressed purpose of delivering the purchased software or service requested or as set forth in this Privacy Policy.

If you submit personal information to us, or to any third party acting on our behalf as a service provider, we may use and share your information as set forth in this Privacy Policy. We will not use, sell, lease, publish or share your personal information except as set forth in this Privacy Policy. We may use your personal information as described in Sections 1 through 5 above and:

  • To process your purchase of the TruMedia software or services;

  • To manage your TruMedia user account;

  • To provide you with information about the TruMedia software or services you have purchased or used;

  • To communicate with you about the TruMedia software or services you have purchased or used;

  • To improve the user experience and functionality of the TruMedia software, services and websites;

  • To improve customer support;

  • For documentation purposes in case of disputes;

  • In accordance with any other permission you provide, including, without limitation, to send you information about TruMedia software or services that we think you might have interest in, as well as those of our partner companies. We will only do so with your consent. If you agree to receive marketing materials of this type, you may opt out at any time by contacting privacy@trumedianetworks.com.

 2.     Other Circumstances when we might use or share your information.

  • Aggregated and Anonymized Information. We may share aggregated, anonymized information with third parties that is not linked to personal information and is shared for analytics purposes. For example, we use providers like Google Analytics and Mixpanel to understand how you and other customers use the TruMedia websites.  

  • Employer Disclosure.  In the event that your user account is purchased by or contracted for by and between your employer and TruMedia, at your employer’s request and subject to all applicable laws, we may share certain usage data with your employer for purposes of enhancing user experience or improving functionality of the TruMedia software or services.

  • Corporate Transactions. TruMedia may be merged, consolidated or sold, or it may sell or transfer all or substantially all of its assets. Our customer information may be one of the business assets we sell or transfer.

  • Disclosure for Legal Purposes. We may be required to share your information pursuant to pursuant to applicable law, regulation or due legal process.  We also reserve the right to use, disclose or share your information in order to establish or defend our legal rights or investigate or prevent situations involving potential threats to your safety or the safety of any person.

C.     How do we store your information and for how long?

TruMedia securely stores and processes your information on secure Amazon Web Services cloud servers or other well-known cloud service providers located in the United States of America.  If you submit personal information to us, or to our service provider acting on our behalf, you will be voluntarily transferring this personal information to the United States. 

We implement industry standard security protocols to protect your information and we regularly review our security and information storage protocols. 

TruMedia retains personal information we collect from you for the period of time you are a customer of TruMedia or maintain a user account.  We will retain such information as long as there is a legal, taxation, regulatory, accounting, risk management, business requirement or legitimate interest to do so, for a period not to exceed seven (7) years, unless circumstances require us to extend the retention period until an investigation or dispute is fully resolved.

D.    What are your data protection rights?

You may choose and control what information you provide about yourself and certain information which is automatically collected by TruMedia.  If you do not wish to provide certain information necessary for proper functionality of the TruMedia software or services, please do not use the TruMedia software or services.

If you want to review or revise other personal information you have provided to us, or to close your account(s) and have us delete the applicable account personal information (except that information necessarily retained for legal, taxation, regulatory, accounting, risk management or business requirement), please contact us at privacy@trumedianetworks.com

If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows a user to accept or reject most cookies.

For customers in the European Economic Area, you may have the right to request that TruMedia:  

  •  provide copies of your personal information;

  • correct any personal information you believe is inaccurate or incomplete;

  • in certain circumstances, subject to limitations set forth in applicable laws, erase of your personal information; or

  • in certain circumstances, subject to limitations set forth in applicable laws, restrict or object to the processing of your personal information.

E.     Rules applicable to children.

Children under the age of thirteen are not permitted to use or access any TruMedia software or services without the consent of that child's parent or guardian. 

F.     Privacy policies of other websites.

The TruMedia website may contain links to other websites. Our Privacy Policy applies only to our website, so if you click on a link to another website, you should read their Privacy Policy.

G.    Changes to our Privacy Policy.

TruMedia keeps its Privacy Policy under regular review and places any updates on this web page. This Privacy Policy was last updated on August 25, 2022.
